Terms of Service

These terms cover your use of 2nd Sight, a product of 2nd Gen Kitchens. They are written to be read: plain sentences, no defined terms in capitals, and the parts that limit what you can rely on are stated where you would look for them rather than buried.
What you are buying
2nd Sight analyses public records about Chicago restaurants and produces estimates — survival scores, revenue and rent bands, concept fit, and the history of a given address. There are four ways to use it:
- Free. One full read per calendar month, plus the parts of the product we keep open to everyone.
- Site Report. A one-time purchase covering one address and concept. It is a snapshot: it records the model version and data vintage that produced it and does not change afterwards.
- Pro. A monthly subscription, currently with a 14-day free trial.
- Team. A monthly subscription covering five seats.
Prices, limits and trial length are whatever is shown at checkout when you buy. If we change them, the change applies to your next renewal, not retroactively.
Subscriptions renew until you cancel
Pro and Team are recurring subscriptions. We take your card details when you start, including when you start a free trial, and the subscription renews automatically each month at the then-current price until you cancel. A free trial converts into a paid month when it ends unless you cancel before then.
You can cancel at any time and keep access until the end of the period you have paid for. We do not pro-rate partial months. Cancelling a subscription does not delete anything you have already bought or saved — see Your data below.
Refunds are covered by a separate policy so it can be found on its own, and it forms part of these terms.
What the scores are, and what they are not
No warranty on any estimate. Every score, band and forecast is a statistical estimate built from historical records. It describes how comparable concepts at comparable addresses have performed. It is not advice, not a guarantee, not a valuation, and not a prediction about your business. It will be wrong on a meaningful share of individual addresses.
We publish our methodology, our out-of-time validation results and the hypotheses we tested and rejected, precisely so you can judge how much weight the numbers deserve. We make no promise that any figure is accurate, complete or current, and specifically not that it predicts any particular outcome. Licence records can show a business as active for months after it has actually closed; the product is validated for Chicago only.
Decisions about a lease, a purchase, a loan or a concept are yours. Use the product as one input alongside your own diligence and your own professional advisers. We are not your broker, appraiser, accountant, lawyer or adviser, and nothing in the product creates that relationship.
Acceptable use
Not for adverse decisions: a score must not be used as a basis for denying credit, a lease, or a similar application about a person or business. It has not been validated for that use.
You also agree not to:
- resell, redistribute or publish the underlying data or bulk outputs, or use the product to build a competing dataset or model;
- scrape or automate access outside a documented interface we have given you access to, or work around rate limits, paywalls or seat counts;
- share an individual account, or exceed the seats on a Team plan;
- present our estimates as your own analysis, or as fact, or strip the accompanying statement about their limits when you forward a report;
- use the product unlawfully, or to harass or discriminate against anyone.
Sharing a report with your own client, colleague or lender in the ordinary course of a transaction is expected and fine.
Your data, our data
What you put in — the addresses you look up, your notes, your account details — stays yours. You give us permission to process it to run the product, and to use it in aggregated, de-identified form to improve the model. We will not publish or sell anything identifying you or your queries.
What we produce — the software, the models, the scores and the reports — stays ours. A purchase gives you a perpetual, non-exclusive right to use and share the report you bought for your own business purposes, including with your clients. It does not transfer ownership of the model or the data behind it.
Underlying public records belong to whoever published them. Our Data sources page lists each one, its terms, and what we do and do not pass on.
Parts of this product use Google Maps Platform services (Places data), and your use of those parts is also subject to Google's Terms of Service and Privacy Policy. Where a figure is derived from Google data we say so and attribute it to Google.
Availability and changes
We aim to keep the product up and the data current, and we publish when each dataset was last refreshed so you are never guessing. We do not promise uninterrupted service. Public data sources can change or disappear without notice, and when that happens we would rather tell you a figure is stale than quietly serve it as fresh.
The product will change. We may add, alter or withdraw features. If we make a change that materially reduces what a paid plan includes, we will tell subscribers by email before the next renewal so the decision to continue is yours.
Limits on liability
To the extent the law allows: the product is provided as-is, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business opportunity or loss of data, arising from your use of the product — including any decision you make in reliance on an estimate.
Our total liability for any claim relating to the product is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
Ending the agreement
You can stop using the product and close your account at any time by emailing hello@use2ndsight.com. We may suspend or close an account that breaches these terms, does not pay, or is being used in a way that puts the service or other customers at risk. Where the circumstances allow it, we will warn you first.
The sections on acceptable use, ownership, liability limits and governing law survive the end of this agreement.
Governing law and disputes
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules, and the state and federal courts located in Cook County, Illinois have exclusive jurisdiction over any dispute.
Before filing anything, please email us. Nearly everything is faster to fix directly, and we would rather fix it.
Changes to these terms
If we change these terms materially, we will update the date at the top of this page and email anyone with an active account before the change takes effect. Continuing to use the product after that means the new terms apply. If you do not accept them, cancel — and if the change is one you find unreasonable mid-term, tell us and we will sort out the remainder of what you paid.
